1. ORGANIZATION
Lydia Solutions (hereinafter referred to as "Lydia" and hereinafter referred to as "the Organizer"), a simplified joint stock company with a capital of €1,785,216.00, having its registered office at 14 avenue de l'Opéra, 75001 Paris, registered with the Paris Trade and Companies Register under the number 534 479 589, registered with the Autorité de contrôle prudentiel et de résolution under the number 62677,
Organizes between Monday, May 2, 2022 and Sunday, May 8, 2022, a free contest entitled "Win an Xbox by subscribing to a Lydia Black account" (hereinafter referred to as "the Contest") for users of the Lydia solution for Individuals (hereinafter referred to as "Users"). The terms and conditions of the Contest are set out below.
2. TERMS AND CONDITIONS OF PARTICIPATION IN THE CONTEST
2.1 Eligibility criteria for Participants:
The "Win an Xbox by signing up for a Lydia Noir account" contest is only available to Users of the Lydia Solution for individuals who meet the following cumulative characteristics and criteria:
- User is eighteen (18) years of age or older. A copy/photo/scan of both sides of a valid official identity document (national identity card, passport, residence permit, European driving license - EEA) may be required by the Organizer at the time of delivery of the prize to the winner(s) in order to confirm his/her legal majority;
- The User has a French Metropolitan cell phone number (geographical code: + 33) linked to his/her Lydia Particulier account;
- The User has a verified Lydia profile (KYC done);
- The User, who does not have a Lydia Noir subscription at the time of the launch of the Contest, has subscribed to a Lydia Noir subscription during the period of availability of the Contest.
2.2 Criteria for participation in the Competition
2.2.1 Participation in the Contest will be automatically taken into account by the Organizer upon completion of a subscription to the Lydia Black current account, either monthly or yearly (twelve month commitment).
2.2.2 The chances of the newly subscribed Lydia Black current account user will be doubled, if he/she makes an eligible payment transaction of a minimum amount of five (5) euros using a Lydia payment card on Monday, May 2, 2022 and May 8, 2022 (from 2:00 pm to 11:59 pm). Any participation outside this period will not be counted.
2.2.3 The following are also expressly excluded and declared ineligible for the Contest by the Organizer
Payment transactions of less than five euros (€5) ;
Payment transactions made through a banking, payment or electronic money or investment service provider other than Lydia, its principals and partners;
Payment transactions consisting of, or having as their purpose, top-ups of bank, payment, e-money and investment accounts, external to the Lydia payment money account and any other transactions similar to "quasi-cash" having as their purpose to feed the above mentioned external accounts. The transactions are identified according to the so-called "MCC" codes of the VISA "Merchant Category Classification". The MCC code 6051 is concerned here. Non-Financial Institutions - Foreign Currency, Non-Fiat Currency, Money Orders (Not Money Transfer), Account Funding (not Stored Value Load), Travelers Cheques, and Debt Repayment;
Payment transactions for the purpose of conducting gaming and wagering transactions, including lottery tickets, casino chips, wagers, and off-track betting (MCC 7995. Betting, including Lottery, Tickets, Casino Gaming Chips, Off-Track Betting, and Wagers at Race, Tracks and games of chance to win prizes of monetary value) ;
Cash withdrawals made at a bank branch counter or through an ATM or machine of a banking institution (MCC 6010. Financial Institutions, Automated Cash Disbursements. 6011 Financial Institutions - Automated Cash Disbursements);
Payment transactions consisting of, or having as their purpose, VISA or MasterCard cashback (MCC 6050. Quasi cash-member financial institution);
Operations for the purpose of identifying payment transactions (MCC Payment Transaction, Customer Financial Institution).
Payment transactions that are not completed, not successful, refused, abandoned, stopped by accident and/or refunded by the payee.
Payment transactions carried out in violation of the General Terms and Conditions of Use of Lydia Particuliers and the Terms and Conditions of Use of the VISA x Lydia card.
Only entries that meet the above criteria will be considered for the draw.
2.2.4 Participation in the Sweepstakes is exclusive of any other promotional offers, cashback or sweepstakes organized by Lydia Solutions. Users who have already been designated as beneficiaries of another promotional offer will be excluded from the competition.
3. PRIZES OF THE CONTEST
The following prize will be drawn for the Participants of the contest: (hereinafter referred to as the "Prize"): an Xbox SERIES X worth 499.99 euros (€).
The characteristics of the Prize are as follows:

- Xbox Velocity Architecture
The package offered includes:
- The Xbox Series X Console,
- A wireless controller,
- The Ultra High Speed HDMI,

4. METHOD OF AWARDING AND RECEIVING THE PRIZE
A random draw will be held by the Organizer between 10:00 a.m. and 7:00 p.m. on Monday, May 23, 2022 among the Users whose entries have been declared valid (hereinafter referred to as the "Participants").
The draw will determine among the eligible Participants, the winning Participant of the Contest (hereinafter referred to as the "Winner").
Following this draw, the Winner will be contacted on Monday, May 23, 2022 (starting at 2:00 p.m.) by email by the Organizer in order to be announced the winning result of the Contest in his/her favor.
The Winner, once contacted, will be required to respond to the Organizer within twenty-four (24) hours of being contacted to confirm acceptance of the prize won. Any Winner who has not responded within this time period will be deemed to have definitively forfeited his/her prize. The
The winner is not required to accept the Lot, drawn for their benefit.
As of the acceptance by the Winner, the Lot will be delivered to the winner by Colissimo or Chronopost within a maximum of 3 working days by the Organizer.
All prizes are nominative and cannot be exchanged or refunded in cash, nor can they be combined, nor can they be retroactive or extended. The Winner may not claim the cash equivalent of the prize won or request its exchange for other goods or services.
The Winner must have consented to communicate their personal data - name, first name, age and email address, postal address - to the Organizer, so that the latter can contact them by email, to announce the winning result of the Contest in their favor and then send them the Lot won (by dematerialized means).
The Winner also agrees to provide, upon request, to the Organizer, all information necessary to verify their identity. The Winners attest to the veracity of the information they provide to the
Organizer and authorize all legal verifications concerning the information provided. Any information that is incomplete, false, erroneous, illegible, unusable and/or does not correspond to what was declared at the time of participation in the Contest and during the entire period of participation in the Contest will result in the nullity of the participation, the Participant not being able to claim the awarding of a prize or losing the benefit thereof.
5. FILING OF THE RULES OF THE GAME
The rules of the Contest (hereinafter referred to as the "Rules") are deposited in their entirety, free of charge and for the entire duration of the advertising campaign, on the website Le Manuel de Lydia (https://support.lydia-app.com) at the following URL address: https://support.lydia-app.com/l/fr/category/f63fvf9b2m-les-regles.
They will come into force as soon as they are posted online and each Participant will be deemed to have accepted them simply by participating in the Contest as soon as they are posted online. The Rules may be modified at any time by the Organizer and will be published in their amended form at the locations indicated above. The Rules thus amended shall come into force as of their posting online. Any Participant who does not agree with the amendment(s) must withdraw or cease participation in the Contest.
6. RESPONSIBILITIES
The Organizer shall not be held liable if, in the event of an event constituting a case of force majeure as defined by Article 1218 of the French Civil Code and by the case law of the Cour de cassation, the Contest should be modified, suspended, shortened, terminated or cancelled.
The Organizer may modify or terminate the Contest if it appears that fraud or attempted fraud, proven or suspected, through the use of artificial, fraudulent or criminal means or schemes, has occurred, in any form whatsoever and at any time in the context of participation in the Contest.
The Organizer reserves, in such event, the right not to award the Prize of the Contest or to withdraw it from any person suspected of having performed one or more fraudulent acts during his/her participation or during the use of the Lydia Application for individuals.
Therefore, the Organizer shall not be liable if, as a result of attempted or actual fraud, or the use of artificial, fraudulent or criminal means, the Contest or the designation of the Winner should be cancelled, postponed or modified, or the duration of the Contest shortened.
Each Participant agrees and undertakes to bear all damages or losses caused or suffered as a result of his or her participation in the Contest, unless otherwise provided by public policy.
7. PROTECTION OF PARTICIPANTS' PERSONAL DATA
Participants' personal data will be processed by Lydia, as data controller, for the sole purpose of processing their participation in the Contest, in accordance with the French Data Protection Act No. 78-17 of January 6, 1978 and the European Regulation No. 2016/679 on the protection of personal data (RGPD).
All Participants have the right to access their personal data. He/she may request the rectification or deletion of his/her personal data. They also have the right to object to the processing of their personal data, without giving any reason in the case of commercial canvassing (including by post and telephone), or to justify a particular situation in other cases, or to request that the said processing be limited. It is also possible to request the communication of personal data in a structured and standard format. Finally, the Participant has the right to define directives concerning the fate of his/her personal data after his/her death.

8. APPLICABLE LAW, CLAIMS, JURISDICTION
The law applicable to these Rules is French law. Only the French version of these Rules is binding.

Unless otherwise provided for by public policy, the Paris court of law will have jurisdiction to deal with any dispute between the parties that has not been resolved amicably within three months of the dispute arising.
