Terms of the Cashback Offer "Black Friday"

1. ORGANISATION

Lydia Solutions (hereinafter referred to as "Lydia"), a French Société par Actions Simplifiée (SAS) with a capital of €1,590,731, having its registered office at 14 Avenue de l'Opéra - 75001 Paris, registered with the Paris Trade and Companies Register under number 534 479 589, registered with the Autorité de Contrôle Prudentiel et de Résolution under number 62677 and mandated by SFPMEI, "Partenaire Bancaire" as Agent Provider of Payment Services (hereinafter referred to as "the Organiser").

Organises on Friday 26th November 2021 a Cashback Offer entitled "Black Friday", for users of the Lydia solution for Individuals and holders of a Lydia VISA debit x card or using the Lydia contactless mobile payment solution (hereinafter referred to as "Users"). The terms and conditions of this "Black Friday" operation are set out below.

2. PARTICIPATION CONDITIONS

The "Black Friday" cashback offer is only valid on Friday 26th November 2021.

The "Black Friday" cashback offer is only accessible to Users of the Lydia solution for Individuals who have been invited by a push notification via the Lydia for Individuals application to participate in the offer (excluding other Users) and who meet the following cumulative characteristics and criteria:

  • The User is eighteen (18) years of age or older;
  • The User has a French or Portuguese mobile phone number (geographical codes: + 33 or +351) linked to his/her Lydia Particulier account;
  • The User has a verified Lydia profile (KYC achieved);
  • The User subscribed to a Lydia Black Plan on Thursday November 25, 2021 or Friday November 26, 2021;
  • The User holds a virtual or physical VISA x Lydia card ;
  • The User has made at least one payment transaction with his/her VISA x Lydia card (VISA debit card) OR has used the Lydia contactless mobile payment solution OR has used a Lydia Internet card (VISA X Lydia ephemeral virtual card).

It is also agreed that only three (3) transactions per User meeting the characteristics and criteria set out above are eligible to the Offer. The eligible transactions are the first transactions made during the period of availability of the Offer.

It is expressly provided that the Offer is only valid for the first 10,000 Users completing an eligible transaction during the Offer Availability Period.

The following are also expressly excluded from the Offer and declared ineligible for the Offer by the Organizer:

  • Payment transactions made through other financial services and payment service providers such as Paypal or Curve and other identical or similar services;
  • Payment transactions which are not completed, unsuccessful, refused, abandoned, stopped by chance and/or refunded by the payee;
  • Payment transactions carried out in violation of the General Terms and Conditions of Use of Lydia for Individuals and the Terms and Conditions of Use of the Lydia Visa x Card are expressly excluded from the Offer.
  • Payment transactions carried out in a bar, café or restaurant located in mainland France or Portugal; these places are listed below:
    • Eating places, restaurants and caterers (MCC code: 5811-5812),
    • Pubs (MCC code: 5813),
    • Fast food restaurants (MCC code: 5814).

3. TERMS AND CONDITIONS FOR AWARDING PRIZES

Twenty percent (20%) of the amount of the eligible transaction(s), with the express limit of a refunded amount of fifty euros (€50), will be refunded to the User within seven working days following the period of availability of the Offer (between 9:00 AM and 7:00 PM). The User will be informed through a notification in the Lydia for Individuals app.

Users who are eligible for Cashback and who receive a refund on their payment within the above-mentioned limits undertake to provide the Organizer, on request, with all the information necessary to verify their identity and transactions. Users attest to the truthfulness of all information they provide to the Organizer and authorize all legal checks on the information provided.

Any information that is incomplete, false, inaccurate, illegible, unusable and/or does not correspond to what was declared when registering for the Lydia Solution for individuals for the entire duration of the Offer will result in the invalidity of the Winner's participation and he/she will not be able to claim to have won and will lose the benefit of his/her refund.

The Organizer may not be held liable if, in the event of an event constituting a case of force majeure as defined by Article 1218 of the French Civil Code and by the case law of the “Cour de cassation”, the Offer has to be modified, suspended, shortened, terminated or cancelled.

The Organizer also reserves the right to extend the period of participation in the Offer and to postpone its end.

The Organizer may modify or terminate the conditions of the Offer if it appears that fraud or attempted fraud, whether actual or suspected, through the use of artificial, fraudulent or criminal means or schemes, has occurred in any form at any time in connection with participation in the Offer.

The Organizer reserves the right, in this case, not to award prizes or to withdraw them from any person suspected of having carried out one or more fraudulent acts in connection with the Offer or the use of the Lydia Application for individuals.

The Organizer cannot be held responsible if, as a result of attempted or proven fraud, the use of artificial, fraudulent or criminal means, the running of the Offer or the designation of the Winner were to be cancelled, postponed or modified, or the duration of the Offer shortened.

By participating in this Offer, each User agrees and undertakes to bear alone any damage or loss caused or suffered as a result of his/her participation in this Offer, unless otherwise provided by public policy.

4. DEPOSIT OF THE GENERAL CONDITIONS OF THE OFFER

The General Terms and Conditions of the Offer (hereinafter referred to as the “T&Cs”) are available for the duration of the Offer on the "Lydia App" mobile application and on the Lydia website at the following URL: https://support.lydia-app.com/l/en/category/f63fvf9b2m-les-regles.

The T&Cs may be amended at any time by the Organizer and will be published in their amended form at the locations indicated above. The amended T&Cs will come into force as of their publication.

They shall be deemed accepted by the participants in the Offer, as soon as the Users carry out a payment transaction eligible for refund, following the online accessibility of the thus modified T&Cs.

5. RESPONSIBILITIES

The Organizer may not be held liable if, in the event of an event constituting a case of force majeure as defined by article 1218 of the French Civil Code and by the case law of the “Cour de cassation”, the Offer has to be modified, suspended, shortened, terminated or cancelled.

The Organizer also reserves the right to extend the period of participation in the Offer and to postpone its end.

The Organizer may modify or terminate the conditions of the Offer if it appears that fraud or attempted fraud, proven or suspected, through the use of artificial, fraudulent or criminal means or schemes, has occurred, in any form whatsoever and at any time in connection with participation in the Offer.

The Organizer reserves the right, in this event, not to award the Cashback winnings or to withdraw them from any person suspected of having carried out one or more fraudulent acts when participating in the Offer or when using the Lydia Application for individuals.

The Organizer reminds you that any purchase made in violation of the Lydia Individuals Terms and Conditions of Use and the Lydia Visa x Card Terms and T&Cs are expressly excluded from the Offer.

The Organizer can therefore not be held liable if, as a result of attempted or proven fraud, the use of artificial, fraudulent or criminal means, the running of the Offer or the designation of the Winner were to be cancelled, postponed or modified, or the duration of the Offer shortened.

By participating in this Offer, each User accepts and undertakes to bear alone any damage or loss caused or suffered as a result of his/her participation in this Offer, unless otherwise provided by public policy.

6. APPLICABLE LAW, CLAIMS, JURISDICTION

These T&Cs are subject to French law, unless otherwise provided by public policy. Only the French version of these terms and conditions is binding.

For any dispute not amicably resolved, and except for public policy provisions to the contrary, the French courts will have jurisdiction.
